Constitution of the Republic of Singapore (Amendment) Act 1989
Act No. 1 of 1989

Long title: An Act to amend the Constitution of the Republic of Singapore.

Passed by Parliament on: 25 January 1989.

Assented to by President on: 26 January 1989.

Publication date: 27 January 1989.

Commencement date: 27 January 1989 except for section 2 which is deemed to have come into operation on 19 November 1971.

Summary: This Act removes any doubt as to the appointment of any person under Art. 94(3) of the Constitution to be the Chief Justice and provides that any question as to the validity of any decision or act under Art. 149 shall be determined in accordance with the provision of any Act made pursuant to the new Art. 149(3).

Comments: Section 2 is retrospective in operation.

Building Control Act 1989
Act No. 9 of 1989

Long title: An Act to consolidate and amend and to make further provision concerning the law relating to buildings, and for matters connected therewith.

Assented to by President on: 22 March 1989.

Publication date: 14 April 1989.

Commencement date: 1 May 1989 vide S.163/89 except s.10(3).

Summary: This Act replaces the Building Control Act and revises and strengthens the law in respect of buildings control by -

  1. (a) enhancing the powers of the Building Authority in relation to regulation of building works and safety of buildings;

  2. (b) implementing a system of independent checking of structural plans by accredited checkers;

  3. (c) requiring construction supervision by qualified persons and site supervisors;

  4. (d) requiring certain tests to be carried out under the supervision of a structural engineer;

  5. (e) requiring mandatory inspection of buildings at regular intervals by strutural engineers; and

  6. (f) providing for enhanced penalties.

Central Provident Fund (Amendment) Act 1989

Long title: An Act to amend the Central Provident Fund Act (Cap 36).

Summary: This Act amends the Central Provident Fund Act to empower the CPF Board to establish an insurance scheme to be known as the Dependants’ Protection Insurance Scheme.

Comments: The Scheme provides for the insurance unless a member “opts out”.

Controlled Premises (Special Provisions) (Amendment) Act 1989

Long title: An Act to amend the Controlled Premises (Special Provisions) Act (Cap 60).

Publication date: 31 March 1989.

Commencement date: 31 March 1989 vide S.114/89.

Summary: This Act amends the definition of ‘develop’ in the Controlled Premises (Special Provisions) Act to include the carrying out of any renovation or building works within a conservation area which would enhance or restore the character or appearance of those premises.

The Controlled Premises (Special Provisions) (Amendment) Rules 1989 (S.94/89)

Declaration Under Section 3(1) of the Controlled Premises (Special Provisions) Act (S.113/89) (re designation of development areas).

Comments: This amendment would effectively allow the landlord who has plans to carry out such works on his rent controlled premises to apply for decontrol.

Long title: An Act to provide for the confiscation of benefits derived from corruption and for purposes connected therewith.

Summary: This Act introduced new powers for tracing and freezing the benefits of corruption and for confiscating those benefits.

Comments: Many of the provisions in this Act are similar to the UK Drug Trafficking Offences Act 1986.

Customs (Amendment) Act
1989 Act No. 19 of 1989

Long title: An Act to amend the Customs Act (Cap 70).

Passed by Parliament on: 7 April 1989.

Commencement date: 17 April 1989 vide S.165/89.

Summary: This Act amends the Customs Act to make it an offence for a person to leave or attempt to leave Singapore in a Singapore registered motor vehicle with less than half a tank of petrol.

Destitute Persons Act
1989 Act No. 8 of 1989

Long title: An Act to repeal and to re-enact with amendments the Destitute Persons Act (Cap 78) and to provide for matters connected therewith.

Summary: This Act repeals and re-enacts with amendments the Destitute Persons Act to make further provisions to prefer charges against a habitual beggar and to take finger impressions and photographs of any destitute person admitted to a welfare home for the purpose of facilitating identification.

Economic Development Board (Amendment) Act 1989
Act No. 11 of 1989

Long title: An Act to amend the Economic Development Board Act (Cap 85).

Passed by Parliament on: 16 February 1989.

Summary: This Act amends the Economic Development Board Act to -

  1. (a) provide that the Board shall consist of the Chairman and not less than 4 and not more than 11 other members and that the Board shall meet at such times and places as the Board may decide;

  2. (b) provide for the appointment of a chief executive officer;

  3. (c) insert a new section setting out the functions of the Board;

  4. (d) insert a new schedule to the Act setting out the financial provisions; and

  5. (e) empower the Board to foster the growth of Singapore’s services industry.
