District Judge Sarjit Singh:

1. There were three charges against the accused. The prosecution proceeded on one charge of robbery under Section 392 of the Penal Code. One other charge of robbery under Section 392 of the Penal Code and another charge under Section 356 of the Penal Code for snatch theft were taken into consideration. The accused pleaded guilty to the proceeded charge under Section 392 Penal Code. He understood the nature and consequences of his plea. He admitted the facts without qualification. He was accordingly convicted. He also admitted the two other charges and gave his consent to have the two other charges taken into consideration for the purposes of sentencing.

2. The charge proceeded with is:-

DAC 27024/2008

You are charged that you on the 10th of April 2008, at or about 7.20 p.m., in a SMRT Taxi along Chestnut Drive, Singapore, did commit robbery of cash S$350/- (three hundred and fifty dollars only) and one black wallet, valued at S$15/- (fifteen dollars only) containing the following;

a) One Singapore NRIC bearing NRIC No. S 0228740D

b) One Singapore Driving License

c) One OCBC Visa Card

d) One POSB ATM Card

e) Two cash card valued at S$70/- (seventy dollars only)

f) One Nokia HP valued at S$100/-

g) One Vocational Driving License card

h) One SHB 613 B taxi-key

i) One SMRT Employee card

j) One NTUC Union card no. XXX and

k) One adult EZ link card valued at S$12/- (twelve dollars only)

Totalling S$547/- (five hundred and forty-seven dollars only), in the possession of one Lim Chor Oor, M/55 yrs and you have thereby committed an offence punishable under Section 392 of the Penal Code, Chapter 224.

3. The following 2 charges were taken into consideration for the purposes of sentencing:

a. DAC 28342/2008

You, are charged that you, on the 1st day of April 2008 at or about 1.30 pm, in HDB lift A of Blk 207, Chua Chu Kang Central, Singapore, did commit robbery of one black purse (value unknown) containing cash amounting to S$38/- (thirty-eight dollars only) and two pieces of laundry receipts, in the possession of one Mdm Goretti, F/69 years old and you have thereby committed an offence punishable under Section 392 of the Penal Code Chapter 224.

b. DAC 28343/2008

You, are charged that you, on the 1st April of 2008 at or about 4.30 pm, at the void deck of Blk 558, Chua Chu Kang North 6, Singapore, did commit theft of one wallet valued at S$20/- (twenty dollars only) containing the following;

a) One Singapore NRIC bearing registration number No. S 1288478H

b) One adult ‘EZ link card’ valued at S$10/- (ten dollars only)

c) One ‘POSB ATM’ card

d) One ‘OCBC ATM’ credit card

e) One ‘Maybank’ credit card

f) Cash amounting to S$100/- (one hundred dollars only)

Totalling S$130/- (one hundred and thirty dollars only), in possession of one Chan Lai Ying, F/50 years and in committing the said offence, you used criminal force on the said Chan Lai Ying, by snatching the said wallet from her right hand and you have thereby committed an offence punishable under Section 356 of the Penal Code, Chapter 224.

4. The facts for the charge (DAC 27024/2008) proceeded with are as follows:-

“The victim cum the informant is A1) Lim Chor Oor, M/55 yrs NRIC S0228740D who is a taxi driver and driving a SMRT taxi.

2. The accused is B1) Amat Affnoi, M/31 yrs NRIC S 7710229I.

3. On 10 April 2008 at about 9.06 pm, the victim came to Bt Panjang South NPP and lodged an NP 299 report stating that he was robbed while in his taxi along Chestnut Drive. The culprit has made good his escape with his wallet and handphone. Upon receiving the said report, an investigation was initiated.

4. Investigation revealed that on 10 April 2008 at about 7.05 pm, the victim was driving his taxi along Choa Chu Kang Drive when the accused flagged it down. Upon picking up the accused, the victim was informed to drive him to Dairy Farm Road. He then drove to the destination with the accused, who was carrying an umbrella, sat at the rear passenger seat on his left side.

5. It was further revealed, that on the same night while the taxi was reaching the destination, the accused suddenly asked the victim to turn into Chestnut Drive. The victim drove as directed and when the taxi was near the Chestnut Drive Secondary School, the accused directed the victim to stop his taxi. While the victim was stopping his taxi, the accused suddenly pointed the metal tip of the umbrella that he had to the victim’s right rear shoulder blade. The victim was frightened by this and the accused further demanded the victim surrender his belonging to him. Out of fear of bodily injury, the victim surrendered to the accused the following items;

a) One black wallet, valued at S$15/- (fifteen dollars only) containing the following;

b) One Singapore NRIC bearing NRIC No. S 0228740D

c) One Singapore Driving License

d) One OCBC Visa Card

e) One POSB ATM Card

f) Two cash card valued at S$70/- (seventy dollars only)

g) One Nokia HP valued at S$100/-

h) One Vocational Driving License card

i) One SHB 613 B taxi-key

j) One SMRT Employee card

k) One NTUC Union card no. XXX and

l) One adult EZ link card valued at S$12/- (twelve dollars only)

Totalling S$547/- (five hundred and forty-seven dollars only).

6. Upon receiving the said items, the accused then alighted from the taxi and fled along the road and made good his escape. The victim who was not injured then drove to the police post and reported the incident.

7. Follow up investigations led to the arrest of the accused at his residence in a police raid. The police also seized the following items from his room as case exhibits;

a) One POSB ATM Card no. XXX.

b) One black/red stripe jacket and

c) One cash card no. XXX

8. The accused was then escorted to Jurong Police and charged accordingly. He admitted to the offence.”
