Judgment

SUPPLEMENTARY GROUNDS OF DECISION ON COSTS

1. This is a supplementary judgment to the main judgment delivered on 12 November 2001. After having delivered judgment, the parties were invited to submit arguments on the question of costs.

2. Having heard their submissions, I assessed and awarded costs to the Plaintiffs at $32,000 plus reasonable disbursements incurred. The Plaintiffs are now appealing against the quantum of costs allowed.

3. In assessing the costs, I had taken into account the submissions made by the parties and the factors set out in Appendix 1 of Order 59.

4. I had considered the nature of the case including the various interlocutory applications. Having tried the case, I was of the view that there was no complexity or novelty question involved. In the assessment of costs, I also recognized that counsel had to peruse and digest the various experts reports. But these reports are not complex or difficult to understand. For these reasons, I awarded a sum of $32,000.00 for costs. Disbursements are to be dealt with separately as the Plaintiffs have yet to finalize all the disbursements incurred.
