District Judge Kathryn Low Lye Fong: Introduction

The parties were married on 1 November 2003. The Plaintiff (“the husband”), aged 41, is a xxx of a software company. The Defendant (“the wife”), aged 40, is a xxx of a technology company. They have two children, a daughter, aged 10, who was born on 5 March 2005 and a son, aged 5, who was born on 26 February 2009. The husband filed for divorce on 7 February 2013. Interim Judgment was granted to the husband on 25 March 2013 based on the ground that the wife has behaved in such a way that the husband cannot reasonably be expected to live with her. The ancillary matters were heard before me on 5 August 2014 and 3 December 2014.

The issues that had to be determined were as follows: The custody, care and control of the two children of the marriage; division of the matrimonial assets; maintenance for the wife; and maintenance for the children.

Orders made

After considering the social welfare report that has been submitted, the evidence of the parties in the affidavits and the submissions of counsel, I made the following orders: The parties shall have joint custody of the two children of the marriage with care and control to the wife; The wife shall not take the children with her or anyone else for rides on motorcycles; The husband shall have access to the two children as follows: Alternate weekend overnight access on Saturday 11.00am to Sunday 8.30pm and on Sunday 8.30am to 8.30pm; Tuesday and Thursday 6.00pm to 8.30pm; Alternate public holidays, from 11.00am to 8.30pm; Half of all school holidays; Chinese New Year’s eve 5.00pm to 8.30pm and second day of Chinese New Year 11.00 am to 8.30 pm on odd years and first day of Chinese New Year 11.00 am to 8.30 pm on even years; Both parties are to attend counselling on parenting at any family service centre within 1 month of the date of issue of the Certificate of Final Judgment; The wife shall transfer her rights, title and interest in the matrimonial home at xxx to the husband upon the husband paying the wife a sum based on 35% of the valuation of the property to be obtained, less any outstanding mortgage loan. The wife shall refund monies utilized for the purchase together with accrued interests to her CPF account from the sum to be paid to her.
