GROUNDS OF DECISION

1. The Accused appeared in Court and pleaded guilty to the following charge:

DAC 25719/96 "You, [PREVStanley Yim[NEXT Kar Mun, male 18 years NRIC No. 7833759/A are charged that you, on the 1st day of November 1996 at or about 3.10 am, along East Coast Road, Singapore, together with more than 10 unknown others, whose common object was to use force against the patrons of Sin Hoi Sai Eating House situated at 187 East Coast Road, Singapore, and in prosecution of the common object of such assembly, did assault one unknown male Chinese and kicked one Mdm Yap Sor Khim, and you have thereby committed an offence under section 147 of the Penal Code, Cap 224." 2. The Accused admitted without qualification to the following Statement of Facts:

" (1) The informant is Yap Sor Khim, F/40 yrs, NRIC No. S1235268/I. She is the owner of a restaurant called the Sin Hoi Sai Eating House located at No. 187 East Coast Road.

(2) The victims are the customers of Mdm Yap's restaurant, and Mdm Yap herself. The identities of the customers are unknown.

(3) The accused is [PREVStanley Yim[NEXT Kar Mun, M/18 yrs, NRIC No. S7833759/A, residing at Blk 65 Kallang Airport Estate, #07-06, Singapore. He is unemployed.

(4) On 1 November 1996 at about 3.10 am, the informant informed the police that there was a fight along East Coast Road opposite the Bank of China. On the arrival of the police, the accused was arrested.

(5) Investigation revealed that on 1 November 1996 at about 1.15 am, the accused arrived at Raymond Football Club located at the 2nd level of Katong Shopping Centre. The accused met his friends, namely, "Jime", "Jianxin", "Ah Boy" and three others unknown to him. At about 3.00 am, Jime's pager sounded. Jime responded to the pager call. He later informed the accused that he and the others were going to do something. The accused insisted on following them. The seven of them then walked along East Coast Road in the direction of Still Road.

(6) Further investigation revealed that the accused and the group of people he was with arrived at 187 East Coast Road. When they arrived at the scene, they witnessed a scuffle between two persons. One of these persons was bleeding from the head. There were eight persons trying to restrain them. At this juncture, someone shouted in Hokkien, "Kaki lang mai pa" - meaning "Do not fight among own people". This was followed by an instruction in Hokkien, "Pak customers" - meaning "Attack the...
