1. This Grounds of Decision arises from an appeal by the Prosecution against sentence.

2. The Accused, Muhammad Firdaus Bin Kiamel, pleaded guilty to 9 counts of theft from motor vehicles. 38 other similar charges were taken into consideration for purpose of sentencing.

Statement of Facts

3. The Accused admitted to the facts tendered by the prosecution without qualification. The facts are reproduced here:

“1. The accused is Muhammad Firdaus Bin Kiamel, Male, 24 years old, Singapore citizen. The accused was previously employed as a car park enforcement officer with Sembenviro Management Pte Ltd and assigned to carry out car park enforcement rounds in Hougang area. His job scope was to check whether vehicles displayed valid parking coupons. Accused committed all the offences when he was on car park enforcement rounds in Hougang area. Accused committed the offences by stealing cash cards left in the in- vehicle unit of motorcycles only.

FACTS RELATING TO THE 1^ST CHARGE (DAC- 10183- 2008)

2. The victim is Yeo Yean Wan, Male, 48 years old, Singapore citizen.

3. On 19/1/08 at about 10.30pm, complainant parked his vehicle bearing registration number GU4843P at the multi- storey car park at Blk 159A Hougang St 11, Singapore. On 20.1.2008 at about 5.50am, victim discovered that his cash card was missing from the in- vehicle unit of his vehicle. The serial number of the cash card is xxxx xxxx xxxx xxxx and it has a stored value of S$16.41/-.

4. Investigation revealed that on 20.1.08 at about 4.49am, accused took the said cash card from the in-Vehicle unit of the said vehicle while he was on car park enforcement rounds and thereafter refunded the stored value into his DBS bank account XXX-XXXXX-X on the same day.

5. Accused admitted he had intention to commit theft of the said item. Victim Yeo Yean Wan affirmed the said item was in his possession at time of offence. Accused had thereby committed theft of the said cash card from a motor vehicle in the possession of victim Yeo Yean Wan and has thereby committed an offence punishable under Section 379 Chapter 224 of the Penal Code.

6. The victim is unknown.

7. Investigation reveals that on or before 17^th January 2008 at an unknown car park in Singapore, accused did commit theft of a cash card with serial number: xxxx xxxx xxxx xxxxx containing a stored value of S$34.35/-.

8. Accused admitted he had intention to commit theft of the said item. Accused has taken the said cash card from the In- vehicle Unit of an unknown motorcycle parked in the said car park. The accused did this while on his car park enforcement rounds. Thereafter accused refunded the stored value into his bank account for his own use. Accused had thereby committed theft of the said cash card from a motor vehicle in the possession of an unknown owner. He had thereby committed an offence punishable under Section 379 Chapter 224 of the Penal Code.

10. Investigation reveals that on or before 19^th January 2008 at an unknown car park in Singapore, accused did commit theft of a cash card with serial number: xxxx xxxx xxxx xxxx containing a stored value of S$22.45/-.

11. Accused admitted he had intention to commit theft of the said item. Accused has taken the said cash card from the In- vehicle Unit of an unknown motorcycle parked in the said car park. The accused did this while on his car park enforcement rounds. Thereafter accused refunded the stored value into his bank account for his own use. 13. Investigation reveals that on or before 22^nd January 2008 at an unknown car park in Singapore, accused did commit theft of a cash card with serial number: xxxx xxxx xxxx xxxx containing a stored value of S$26.78/-.

14. Accused admitted he had intention to commit theft of the said item. Accused has taken the said cash card from the In- vehicle Unit of an unknown motorcycle parked in the said car park. The accused did this while on his car park enforcement rounds. Thereafter accused refunded the stored value into his bank account for his own use. Accused had thereby committed theft of the said cash card from a motor vehicle in the possession of an unknown owner. He has thereby committed an offence punishable under Section 379 Chapter 224 of the Penal Code.
