JUDGMENT:

Grounds of Decision

The accused was upon his plea of guilty convicted on the following charges:

"DAC 12363/2001 (Exhibit P1B)

You,

B1. Ng Chee Bing, Male 22 years
NRIC No: S 7837391-A

are charged that you on 26th February 2001, at about 5.30 pm, at the staircase of Tiong Bahru Plaza, Singapore, together with one Tan Tiam Siew, male 22 yrs old, Nric no: S 7825421-A, in furtherance of the common intention of you both, did commit extortion by putting one Loi Teck Fei, Male 13 years old, in fear of a certain injury, to wit, by threatening bodily harm to him, and thereby dishonestly inducing the said Loi Teck Fei, to deliver to you one 'Nokia'model 3310 handphone valued at about $268/-, and you have thereby committed an offence punishable under Section 384 read with Section 34 of the Penal Code Chapter 224."


"DAC 13630/2001 (Exhibit P3A)

You,

B1. Ng Chee Bing, Male 22 years
NRIC No: S 7837391-A

are charged that you on 26th February 2001, at about 6.00 pm, at infront of Blk 92 Zion Road, Singapore, together with one Tan Tiam Siew, male 22 yrs old, Nric no: S 7825421-A, in furtherance of the common intention of you both, did commit extortion by putting one Loi Teck Fei, Male 13 years old, in fear of a certain injury, to wit, by threatening bodily harm to him, and thereby dishonestly inducing the said Loi Teck Fei, to deliver to you the following items:

a) Cash $5/-
b) One 'Jean Paul Gaultier' wallet valued at about $80/-
c) Two transit link cards with total value of about $3/-
d) One phonecard with value of about $5.60/-

and you have thereby committed an offence punishable under Section 384 read with Section 34 of the Penal Code Chapter 224."


"DAC 32360/2001 (Exhibit P4)

You,

Ng Chee Bing, male 22 years
NRIC No: S 7837391A

are charged that you on or about the 26th day of May 2001 at about 3.31 am along East Coast Park, Singapore, did drive motor car SCK 9666 B on the road whilst you have so much alcohol in your body that the proportion of it in your blood exceeded the prescribed limit, and you have thereby committed an offence punishable under Section 67(1)(b) of the Road Traffic Act, Chapter 276."


"DAC 32361/2001 (Exhibit P5)

You,

Ng Chee Bing, male 22 years
NRIC No: S 7837391A

are charged that you on or about the 26th day of May 2001 at about 3.31 am along East Coast Park, Singapore, did drive motor car SCK 9666 B without reasonable consideration for other persons using the road, to wit, by failing to have proper control of your vehicle causing it to veer to the left and hit onto the left guard rail before it came to a halt at the centre lane and you have thereby committed an offence punishable under Section 65 of the Road Traffic Act, Chapter 276."

2. The facts in respect of the extortion charges were as follows:

" Victim is A1 Loi Teck Fei, M/13 years old, Nric no: S8738322-I. He is a student.

2. Witness is A2 Khung Wei Nam, M/13 years old, Nric no: S8737164-F. He is a student.

3. Accused is Ng Chee Bing, M/22 years old, Nric no: S7837391-A. He is a salesman.

4. Accomplice is Tan Tiam Siew, M/22 years old, Nric no: S7825421-A. He is a bunker clerk.

5. On 26.2.2001, at about 7.50 pm, the victim lodged a police report at Kim Seng NPP, stating that on the same day at about 5.30 pm, he and his friend A2 were at Tiong Bahru Plaza. Two unknown male subjects approached them and grabbed them on their neck and ordered them to take a cab to Havelock Road infront of Blk 92 Zion Road. There at the playground, one of the subjects took away their wallets and handphone. Afterwhich, the said subject slapped his cheek and punched him on the face.

6. On 27.3.2001 at about 8.15 pm, acting on information, the police arrested the accused at Tiong Bahru Plaza. On the same day at about 10.15 pm, the accomplice was arrested at no. 246 Indus Road, Emerald Park Condominium.

Facts relating to 1st charge - DAC 12363/2001

7. Investigations revealed that on 26.2.2001, at about 4.30 pm, the victim A1 and A2 were at Tiong Bahru Plaza games arcade, located at the 4th floor, playing games. At about 5.00 pm, they took a rest outside the arcade and squatted next to the exit door of the said arcade.

8. While squatting there, at about 5.30 pm, the accused and his accomplice opened the door to the exit and the door hit A1 slightly. A1 took a look at them and thereafter ignored them. A1 and A2 left the place to the lobby. The accused and his accomplice then confronted the A1 and A2. The accused spoke in Hokkien and asked A 1 and A2, which secret society groups they belong to.
