Grounds of Decision

1. The accused is Anand Kumar Ram Kumar, m/18 yrs, Nric: 8223985-E of Blk 5 Pine Close #03-135, Singapore. He was charged as follows:

are charged that you on or about the 18th day of July, 1999 at or between 6.00 pm to 6.30 pm, at the playground of Blk 417 Bedok North Ave 2, Singapore, which is a public place, did have in your possession offensive weapons, to wit, seven pieces of metal rods, otherwise than with lawful authority or for lawful purpose, and you have thereby committed an offence punishable under Section 6(1) of the Corrosive and Explosive Substances and Offensive Weapons Act, Chapter 65.

2. On 18.7.99 at about 6.00 pm, an anonymous male caller called the police and reported that a group of boys were armed with iron rods and gathering at the playground of Blk 417 Bedok North Ave 2.

3. On the same day at about 6.36 pm, police arrived at the scene and spotted the accused together with 9 other male persons at the playground of Blk 417 Bedok North Ave 2. During the spot check, one of these male persons led the police to the recovery of a bag containing 7 pieces of metal rods measuring about 2½ feet each from the playground. The accused and the other 9 male persons were placed under arrest and brought to Bedok Police Division.

4. Investigations revealed that the accused and the other male persons used to gather at the playground of Blk 417 Bedok North Ave 2. On 18/7/99 between 5 pm and 6 pm the accused and 9 other male persons arrived at their haunt to discuss how to take revenge against a rival gang member who had assaulted a "sworn sister" of a member of their own group. In connection with this the accused went to a void deck nearby and brought back 7 pieces of metal rods which were lying around and told the others in his group that the rods were to be used for their own protection if attacked by the rival gang members.
